New Delhi: In the midst of a major political uproar over Rahul Gandhi’s disqualification after a Gujarat court sentenced him to two years in prison, Lakshwadeep MP Mohammed Faizal’s Lok Sabha membership was restored today after his conviction in a criminal case was stayed.According to sources, Rahul Gandhi’s legal team may use this instance before a higher court in an effort to overturn his conviction and reinstate his membership in the Lok Sabha.

According to sources, Rahul Gandhi may petition a sessions court today or tomorrow to overturn his conviction by a court in Surat, Gujarat.If the Election Commission sets a date for a byelection in Wayanad, the seat that is now vacant due to Rahul Gandhi’s disqualification, the Congress says it is ready to file a lawsuit.

Sharad Pawar’s Nationalist Congress Party (NCP) member Mohammed Faizal was found guilty of attempted murder and given a 10-year prison term. Following his conviction, he was automatically expelled from the legislature.

The Kerala High Court in January suspended the sentence.

Mr Faisal challenged the Lok Sabha secretariat’s “illegal action” in failing to withdraw his disqualification as an MP more than two months after his sentence was suspended.Mr Faisal claims that a false case was filed against him in 2016 in connection with allegations of attempting to murder a relative of former Union Minister PM Sayeed during the 2009 elections.

In the midst of his trial, the NCP leader was elected to the Lok Sabha in 2019. Along with three others, he received a 10-year prison term on January 11. He received a notice of disqualification from the Lok Sabha Secretariat two days later.The Election Commission announced on January 18 that Mr. Faisal’s Lakshadweep seat would go to the polls on January 27. The Kerala High Court suspended Mr. Faisal’s sentence two days before the elections, obliging the Election Commission to postpone the byelection.

Sharad Pawar met with Lok Sabha Speaker Om Birla on January 30 to ask him to overturn the disqualification of his party leader.Even before a decision on Rahul Gandhi’s challenge, the Congress anticipates a legal battle for Wayanad if the Election Commission announces dates today.

According to the Representation of the People Act of 1951, a person who has been convicted of a crime and given a sentence of two years or longer is ineligible to run for office.
