As Rajasthan’s government introduces a bill for their security, attorneys will don a new legal shield.

The advocate protection bill 2023, which calls for a maximum term of seven years in prison and a fine of Rs 50,000 in cases of serious injury to a lawyer, was introduced by the state government on Wednesday. Since the offence has been declared cognisable, bail is not an option. This will only apply to offences committed while the advocate was performing their duties as a court officer on the court grounds.

According to the bill, if an advocate informs the police about an offence against him or her, the police must, if required, offer protection.
In addition to a penalty of two to seven years in prison and a fine of 10,000 to 50,000 rupees depending on how serious the offence was, the offender is also responsible for paying damages to an advocate’s property and paying back any court-ordered medical expenditures.
The fine recovered will be given as compensation to the attorney when a court imposes a fine or any other sentence in which a fine is a component.

A police officer not below the level of deputy superintendent of police must conduct the investigation, and it must be finished in no more than seven days, if a report of a cognizable offence is received against the advocate for an act committed while performing their professional duties. If a matter is subsequently registered, documented documentation of it must be given to the Rajasthan Bar Council.
