If there are disagreements between the judiciary and the administration on the subject of appointing judges, Kiren Rijiju, the law minister, said on Thursday in the Rajya Sabha that these disagreements are a natural part of democracy and that there are methods to find solutions to them.

The administration also stated that Victoria Gowri‘s selection as a high court judge should not be questioned, claiming that she was chosen following a process.

Leader of the House Piyush Goyal requested the chair’s indulgence after being questioned by TMC member Jawhar Sircar on whether Victoria Gowri’s appointment was appropriate despite being publicly accused of making casteist and anti-minority statements.

The Chairman further informed the TMC member that he was referring to someone who is not a House member.

Law Minister Rijiju concurred with the Chair, saying, “You have very rightly made the observation that there are certain sensitive matters that you have to bear in mind when we speak in this august House.” The Supreme Court has already taken a view on that.” Dhankhar responded, “You are making reference to something for which the Honorable President has issued a warrant of appointment, and the Supreme Court has already taken a view on that.”

The former senior bureaucrat is not expected to be informed of the norms, regulations, and decorum, Rijiju said in response to Mr. Sircar’s inquiry regarding any discrepancies between the judiciary and the executive on the appointment of judges.

If there are disagreements, in a way, that is very much a part of democracy. There are disagreements among families and political groups. There are methods for resolving disagreements of opinion as well. He clarified that his inquiry was not directed at the government in search of statistics or other hard data.

Mr. Rijiju said that there are 210 openings when Mr. Sircar claimed that the minister had not responded to his direct query regarding the disparities.
