Jaipur Municipal Corporation is required by the Rajasthan High Court to conduct an investigation into claims of land encroachment

The Rajasthan High Court instructed the Chief Executive Officer of the Municipal Corporation, Jaipur Heritage to look into the petitioner’s case and make a judgement after hearing from all parties.

The Chief Executive Officer of the Municipal Corporation, Jaipur Heritage was ordered by the Rajasthan High Court to conduct an investigation into the petitioner’s complaint and make a decision after hearing from all parties, including those who are alleged to be in possession of the land in question in the Goverdhanpuri Kacchi Basti Area of Jaipur.
In a Public Interest Litigation (PIL) that was brought before the Jaipur Bench of Acting Chief Justice Mahindra Mohan Shrivastava and Justice Anil Kumar Upman, it was claimed that property had been allocated by order dated June 22, 1996 for the construction of a Government Primary Girls School in the aforementioned region.

In a work order dated 27.03.2006, the Municipal Corporation of Jaipur Heritage’s then Executive Engineer (Respondent No.3) released 3.92 lacs for the building of the primary school.

The lawsuit also states that on September 29, 2022, the Chief Executive Officer of the Municipal Corporation of Jaipur Heritage directed that stringent measures be taken to stop illegal building. In an order dated February 13, 2023, the Tehsildar of Jaipur admitted that illegal construction had taken place on the 1611.11 square yards of land that had been designated for the construction of a school building.

The PIL petitioners’ complaint is that no prompt action is being done to remove the encroachment despite several representations being made and some actions being started.

The Bench discovered that the petitioners had made a submission to the Jaipur Development Authority as well as the Municipal Corporation Jaipur Heritage in the month of January 2023.
Who made the intrusion is not identified in the petition. The order stated that not even one respondent had been impleaded against whom allegations of encroachment had been made.

In light of the aforementioned factual aspects of the case, we are inclined to dismiss this petition at this time and direct the Chief Executive Officer of the Municipal Corporation of Jaipur Heritage to conduct an investigation into the petitioner’s complaint and make a decision after speaking with all parties, including those who are allegedly in possession of the disputed property. The ruling said that the investigation had to be finished within three months of receiving a certified copy of it.
