Victoria Gowri Has Sparked Controversy Following Reports Of Her Alleged BJP Affiliation

New Delhi: The Supreme Court today dismissed petitions seeking to prevent lawyer Lekshmana Chandra Victoria Gowri from taking her oath as a Madras High Court judge just as she was about to be sworn in. The oath-taking ceremony began while the hearing in the Supreme Court was still ongoing.

“We will not consider the writ petitions. Reasons will be given later “said a special bench consisting of Justices Sanjiv Khanna and Bhushan Ramkrishna Gavai.

Justice Khanna stated at the start of the hearing that there is a distinction between eligibility and suitability. “There may be an issue with eligibility. However, suitability… If the courts get involved in suitability, the entire process will go haywire “He noticed.

Senior advocate Raju Ramachandran, who had previously petitioned the court for an urgent intervention after the Centre announced Victoria Gowri’s appointment, argued that the decision-making process was hampered because relevant information was not passed to the collegium. The judges stated that they had read everything on the record.Concerning his political background, Justice Gavai stated that it had not interfered with his duties.

“The issue is not one of political background. It is considered hate speech. Hate speech is completely incompatible with the Constitution. As a result, she is unfit to take the oath. It will only be a sham oath “Mr Ramachandran then spoke up.

“I don’t believe we can say this is a question of eligibility. It is more a matter of suitability. Two, we can’t direct the collegium,” the bench said, adding that assuming the collegium hasn’t considered these factors “may not be appropriate.” “.

Some Madras High Court bar members had written to the Chief Justice of India, requesting that the recommendation for appointing Ms Gowri as an additional judge of the high court be withdrawn, claiming she had made hate speeches against Christians and Muslims. Ms Gowri’s proposed elevation has sparked controversy following reports of her alleged BJP affiliation.

After several Madras High Court lawyers objected, 54 lawyers from Tamil Nadu’s Madurai wrote to the Supreme Court collegium, a panel of the highest-ranking judges who decide on appointments to the higher judiciary, endorsing the recommendation to appoint Ms Gowri as a judge in the Madras High Court. Victoria Gowri has represented the Centre in the Madras High Court’s Madurai Bench.
